ASSUMPTION OF RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19

The Coronavirus (COVID-19) has been declared a worldwide pandemic by the World Health Organization.  COVID-19 is extremely contagious and is believed to spread from person-to-person contact, by contact with contaminated surfaces and objects, and/or by air through the dispersion of aerosol droplets expelled by methods that include singing. Hill Havurah will use its reasonable best efforts to implement safety measures consistent with applicable governmental guidelines to reduce the spread of COVID-19.  However, Hill Havurah cannot guarantee that you or your child(ren) will not become infected, exposed to or capable of spreading COVID-19 while engaging physically in any activities located at Hill Havurah facilities or held elsewhere by Hill Havurah. 

ASSUMPTION OF RISK:  I have read and understand the above warning concerning COVID-19 and by signing this waiver and release, I/we acknowledge and agree that  on behalf of myself (ourselves) and on behalf of my/our child(ren) who are under the age of 18, I/we:  (a) understand the contagious nature of COVID-19 and voluntarily agree on behalf of myself/ourselves and my/our child(ren) to wear masks while physically engaging in any activities located at Hill Havurah facilities or held elsewhere by Hill Havurah and to follow other safety measures Hill Havurah may prescribe from time to time; (b) voluntarily assume the risk that while engaging physically in any activities located at Hill Havurah facilities or held elsewhere by Hill Havurah, I/we, my/our child(ren), or anyone for whose health I/we may be responsible, may become infected, exposed to, or capable of spreading COVID-19; and (c) confirm my/our understanding that such exposure or infection may result in personal injury, illness, permanent disability, and/or death to myself/ourselves and members of my/our family.

WAIVER OF LAWSUIT/LIABILITY:  On behalf of myself/ourselves and my/our child(ren) and in consideration of being allowed to engage in Hill Havurah activities physically, I/we hereby waive my/our right to bring any claims against, and release from liability, Hill Havurah and its directors, officers, clergy, other employees, contractors, volunteers, and other participants (“Released Parties”) relating to exposure, infection, and/or spread of COVID-19 arising from engaging physically in any Hill Havurah activity occurring at Hill Havurah facilities or held elsewhere by Hill Havurah.  I/we understand that this waiver means I/we give up my right to bring any and all claims I/we may have against the Released Parties arising out of, relating to, or in any way connected to COVID-19 and Hill Havurah’s activities, including claims of negligence. 

I/WE HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISONS OF THIS RELEASE AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY/OUR RIGHTS CONCERNING LIABLITY AS DESCRIBED ABOVE.
